1. Acceptance of terms
By accessing or using the Taste Twins mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice in the app. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Your account
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account. You may not create an account on behalf of another person without their permission, impersonate any person or entity, or use a name that is offensive, vulgar, or obscene.
4. User content
The Service allows you to post, share, and interact with content including restaurant reviews, dish ratings, and food photos ("User Content"). You retain ownership of your User Content. By posting User Content, you grant Taste Twins a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display your User Content in connection with operating and improving the Service. You represent and warrant that your User Content does not violate any third-party rights, is not defamatory or fraudulent, and complies with all applicable laws.
5. Prohibited conduct
You agree not to: • Use the Service for any unlawful purpose or in violation of these Terms • Post User Content that is false, misleading, defamatory, or harmful • Impersonate any person or entity or misrepresent your affiliation • Attempt to gain unauthorized access to any part of the Service • Use automated means (bots, scrapers) to access the Service without our written permission • Interfere with or disrupt the integrity or performance of the Service • Collect or harvest personal data about other users without their consent • Use the Service to send spam or unsolicited commercial communications
6. Intellectual property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Taste Twins, Inc. and its licensors. The Taste Twins name, logo, Palate DNA, and Flavor Twin are trademarks of Taste Twins, Inc. You may not use our trademarks, trade names, or service marks without our prior written permission.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Restaurant recommendations are generated algorithmically and do not constitute professional dietary or nutritional advice.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASTE TWINS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
9. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Washington, DC.
